1.1 Scope
These Terms govern the sale of all plants, garden supplies, and accessories (the “Products”) from Mynvi.uk to customers within the UK.
1.2 User Eligibility
By placing an order, you warrant that you are at least 18 years of age and legally capable of entering into binding contracts.
2. Product and Orders
2.1 Product Description and Variation
- Live Goods: Our Products are live plants. While we strive to ensure that all photographs and descriptions accurately represent the species, please note that plants are natural products and will vary in size, colour, leaf count, and shape.
- Sizing: All plant dimensions (height, pot size) are approximate.
- Substitution: In rare cases of unforeseen stock issues, Mynvi.uk reserves the right to substitute a plant of similar type, value, and health, after making reasonable efforts to contact the customer.
2.2 Pricing and Payment
All prices are in Pounds Sterling (£) and include VAT (where applicable). We accept payment via major UK payment processors. Orders are only processed upon successful receipt of payment.
2.3 Order Acceptance
The confirmation email you receive is an acknowledgement of your order request and does not constitute final acceptance. We reserve the right to accept or decline your order prior to dispatch for reasons including, but not limited to, stock levels or payment verification issues.
3. Shipping and Delivery of Live Goods
3.1 UK Delivery Only
Mynvi.uk only ships within the United Kingdom.
3.2 Packaging
We utilize specialist, protective packaging designed to maintain the plant’s health during transit.
3.3 Acceptance of Delivery
- Risk: The risk of damage to or loss of the Products passes to you upon delivery.
- Inspection: Due to the perishable nature of our Products, you must inspect all plants immediately upon arrival. Any claim for damage must be made within 24 hours of receiving the order.
4. Cancellation, Returns, and Guarantees
4.1 Right to Cancel (Non-Perishable)
You have the right to cancel your order for non-perishable goods (e.g., accessories, tools) within 14 days without giving any reason, in line with UK consumer law.
4.2 Perishable Goods (Live Plants)
- Exclusion: Under the Consumer Contracts Regulations 2013, the right to cancel is generally excluded for goods that are liable to deteriorate or expire rapidly (perishable goods), which applies to live plants.
- Mynvi Guarantee: We guarantee that our plants are healthy, correctly labelled, and arrive in the condition described. If a plant arrives severely damaged or clearly unhealthy, Mynvi.uk will offer a replacement or refund, provided the claim is raised within 24 hours of delivery with photographic evidence.
4.3 General Plant Care
Mynvi.uk is not responsible for the ongoing health or decline of a plant once it has been successfully delivered. Plant decline due to factors such as improper watering, inappropriate soil, inadequate light, or poor weather conditions is the responsibility of the customer.
5. Limitation of Liability
Mynvi.uk’s total liability to you for any loss or damage arising in connection with the purchase of Products shall be limited to the total price of the Products purchased. We shall not be liable for any indirect or consequential loss.
6. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, and you agree to submit to the exclusive jurisdiction of the courts in that location.
